Success of any organization is based on the ability and skills of its employees how they perform work and the productivity of workers. Each departments should have their goals and they must work to achieve that goals which are linked with the goal of organization. In the above said positions the product supervisor is somehow not cooperative to the employees and other departments. His behavior towards worker is not good. Team meetings in the team is very necessary and effective for productivity but he is doing meeting everyday which was not scheduled It waste time of workers which effect production of company. He should schedule meeting before shift or after shift. Work should not interrupted. Inte rpersonal skill and time management skill here lack in this position. Recommendation to address deficiency in skills and abilities Here there is some recommendations to fulfill deficiency in skills of employees we need to escalate it to higher management and give feedback to supervisor about his behavior and unnecessary waste of time. There is company policies about behavioral issues in the company employees should get aware of these policies. A time management training program should be organized for all employees. To improve skills of employees company should arrange training and development programs. According to my view organization structure of the company is perfect and it is as per optimal structure. Every position is as per hierarchy. Reporting of the staff is to supervisor, supervisor reports to Assistant Manager, Assistant Manager to Head of the department or Manager and Every Manager report to Managing Director of the Company. If there is any issue unresolved by reporting manager it can be escalated to next management level. Alternative of Staffing HELLA NZ is supplier of automobile lights. We hire temporary staff for fixed term in the busy time when there is more demand of lights and during the Christmas period when factory remains closed for three weeks. For other alternative of staff we hire some casual staff to backup of our employees when someone need leave or sick leave. We are also hiring some part time employees to occupy the shifts when there is less workers. We have contract with a recruitment agency who provide us staff when there is need of more employees.

Existentialism is a school of thought, so to speak, where people believe that for every action there is a reaction. Moreover, most of the time, the reaction is a negative one. There is the basic understanding that humans have free will. They have the choice to do whatever they feel in life, which in turn makes life very stressful. Our choices obviously result in some other consequence, and as I said, the consequences, though we may not notice, are negative ones. That is something that cannot really be explained. That is something that happens a lot. Many things are irrational, absurd, and really have no explanation whatsoever. The only that is for sure in our lives is once you decide to do something, you must follow through with it completely and accept whatever may come to you afterwards. Existentialism is sometimes very hard to live by because of the beliefs that go along it with. Someone who is an existentialist believes that human choice is subjective, and that we must makes our decisions not based on outside influences such as laws or ethical standards set forth by society. This essay critically explores the doctrines of consideration and sufficiency within the context of contract law, with references to the matter of Thomas v Thomas from 1842. In assigning significance to these matters, it is noted that Sir John Patteson, a judge in 1830 who was appointed to the Court of Kingââ¬â¢s Bench, (later the Privy Council) was knighted shortly after making the landmark decision regarding the doctrine of consideration in the case of Thomas. The ratio decidendi in Thomas, was ââ¬Ë[c]onsideration must be of value and involve benefit or detrimentââ¬â¢ postulating further that ââ¬Ëalthough consideration must be sufficient, it need not be adequate. ââ¬â¢ CONSIDERATION Eleanor Thomas sued the executors of her husbandââ¬â¢s estate where the court ruled the agreement entered into, was neither nominal nor a voluntary gift, but sufficient in consideration. Consideration is the intention to create legal relations through a bargaining process affording a mutual exchange of a promise for a promise. In Beaton v McDivitt, it is evident that if a transfer was a gift, the essential component of bargaining would be absent. Consideration must be quid pro quo and result in a transfer between the promisor and the promisee, and result in the creation of a relationship of cause and effect. Only the parties involved can enforce the agreement. Consideration may also be a promise to refrain from doing something as Lush J in Currie v Misa states, ââ¬Ëa valuable consideration, in the sense of the law, may consist in some right, interest, profit, or benefit accruing to the one party, or some forbearance, detriment, loss or responsibility, given, suffered, or undertaken by the other. ââ¬â¢ Consideration can involve the forbearing to sue even if the case is unfounded. Past consideration may be valid where it was preceded by a request, however services that would not have been performed but for the implied promise of payment amounts to good consideration. WHEN CONSIDERATION IS NOT CONSIDERATION Consideration may be invalid as in Jones v Padavatton where under the doctrine of presumption, arrangements between family are not binding. Salmon LJ in Jones, in the dissenting obiter dictum, determined that the original agreement created an intention to create legal relations due to the financial consequences of the promise involved, however held there was no binding contract suggesting there was insufficient evidence to rebut the presumption against domestic arrangements. Consideration must be furnished at the time of agreement. Consideration is not valid where a promise to make payment has occurred after the act has been performed. Bargains and conditional gifts for a person who performs an act is not good consideration, nor is a promise to perform an existing duty, or an existing public duty, except where performance goes beyond required expectations. Illegality in consideration is not enforceable giving rise to the expression ââ¬Ëex dolo malo non oritur actioââ¬â¢ meaning ââ¬Ë[n]o court will lend its aid to a man who founds his cause of action upon an immoral or an illegal act. ââ¬â¢ Illusory consideration, where one partyââ¬â¢s obligations are amorphous, is not binding. Limitations and exceptions can apply to consideration however, where additional risks are undertaken. DOCTRINE OF SUFFICIENCY As in Thomas, common law substantially rests on the precept that consideration must be of value to be sufficient, even if it is nominal, without any quantitative economic postulation. Some may suggest such fiscally nominal or token consideration while sufficient, is commercially inadequate in the eyes of a reasonable person, and is itself, illusory. It may be suggested the court has extended itself to invent consideration, where equity may uphold promises not supported by good consideration, through the provision of promissory estoppel. It is incumbent on the parties only to determine the subjective and adequate worth of a promise. Patteson J articulates in Thomas, ââ¬Ëalthough consideration must be sufficient, it need not be adequate. ââ¬â¢ CONCLUSION Blackburn J statement of objective interpretation suggests the objective test must always apply in assessing how a reasonable person would view the situation. It can be concluded that consideration is a matter of essential promissory exchange, while adequacy and value, are the fiscal or functionary exclusive domain of the parties involved. Word count 691
